SIMPLE INFORMATION FOR OBTAINING A VISA

UNDER ITALY’S NEW IMMIGRATION LAW

If you don’t have a valid visa (permesso di soggiorno), under the new law you will be taken to the airport and repatriated. If you are working unofficially your employer will be prosecuted.

For this reason it is extremely important to get a visa under the “regularisation” rules included in the new law (art. 33). In order to qualify for a visa you must satisfy three conditions:

1. You must have entered Italy before the publication of the new law and have credible proof of this (i.e. stamp on passport, health card, season ticket, gas/telephone/power bill, hotel bill, school registrarion receipt, cash-transfer receipt).

2. You must have a clean criminal record and must never have been repatriated.

3. You must have a valid passport with you.

To apply for a visa, you need an Italian citizen (or a foreign citizen living legally in Italy) willing to declare that you are working as a domestic servant (or a carer, if there is an ill or disabled person in the family) at his address.

From August 28 every post-office distributes a kit with “regolarizzazione” forms to apply for visa. They are free and can be collected by anyone but must be filled in by your employer. There are 60 days time for submission, from September 9, but the sooner it is done the lower the risk of repatriation.

After completing the forms, the employer makes a photocopy of the application form (“modulo”) and gives it to the the employee. He then goes to a post-office and submits the forms, making a payment of Euro 330 for contributions and administration costs. The post-office issues a stamped receipt.

The employer then makes a photocopy of the receipt and gives it to the employee. Once you both photocopies with you, you are safe and can live legally in Italy. That’s the first advantage.

After inspecting the application, the Prefettura will write to your employer and fix an appointment with both of you to finalise the procedure. A special centre (Sportello unico) will be soon opened in every town for this purpose.

If all your documents are in order (you will be asked to provide 4 passport-size photographs, a valid passport and evidence of having entered Italy before 26 August 2002) your employer and yourself will sign a “contratto di soggiorno” and you will receive a visa (“permesso di soggiorno”) valid for one year. It is renewable and allow you to work as a domestic servant for any number of employers. No fingerprints will be taken until you eventually renew your visa in one year’s time.

THE ONLY MONEY TO PAY IS EURO 330 WITH YOUR EMPLOYER’S APPLICATION

AT THE POST-OFFICE

A firm employing you as a worker can also obtain a visa for you. The procedure is very similar to that above, with three important exceptions: application forms will be available from September 9, must be submitted within 30 days, and the amount payable is Euro 800.

SEMPLICI ISTRUZIONI PER OTTENERE UN PERMESSO DI SOGGIORNO

IN BASE ALLA NUOVA LEGGE SULL’IMMIGRAZIONE

Chi non ha un permesso di soggiorno valido, rischia di essere accompagnato immediatamente alla frontiera e rimpatriato. Se ha un impiego il datore di lavoro può subire un procedimento penale.

E’ quindi estremamente importate ottenere un permesso di soggiorno in base all’art. 33 della nuova legge. Per fare questo è necessario soddisfare tre condizioni:

1. L’interessato deve essere entrato in Italia prima della pubblicazione della legge e averne una prova credibile (per esempio un timbro sul passaporto, una tessera sanitaria, un abbonamento per i mezzi pubblici, una bolletta di telefono o dell’energia elettrica, una ricevuta di iscrizione a una scuola, la ricevuta di un trasferimento di denaro).

2. L’interessato non deve aver commesso reati o essere già stato rimpatriato.

3. L’interessato deve avere con sé un passaporto valido.

Per la regolarizzazione è necessario che un cittadino italiano (o un cittadino straniero che vive legalmente in Italia) dichiari che siete impiegati alle sue dipendenze come colf (oppure come badante di un famigliare anziano o disabile).

Dal 28 agosto sono in distribuzione presso tutti gli uffici postali le buste con i moduli per la regolarizzazione. Sono gratuiti e ogni persona può ritirarne due al massimo. Spetta al datore di lavoro compilare i moduli. Dal 9 settembre ha tempo 60 giorni per la presentazione, sempre presso un ufficio postale. Naturalmente è meglio fare domanda al più presto per evitare il rischio di rimpatrio forzato.

Dopo aver compilato i moduli, il datore di lavoro fotocopia il modulo con la dichiarazione di emersione e lo consegna all’interessato. Poi va in un ufficio postale e consegna il tutto con un versamento di 330 Euro per contributi e spese postali. Gli viene consegnata una ricevuta timbrata.

Il datore di lavoro dà all’interessato una fotocopia della ricevuta. A questo punto la persona ha il diritto di soggiornare legalmente in Italia fino alla conclusione della procedura di regolarizzazione. Questo è il primo vantaggio.

Esaminata la richiesta, la Prefettura manda al datore di lavoro un lettera per convocarlo insieme all’interessato presso uno Sportello unico che dovrà consegnare gestire la seconda fase dell’operazione.

Se la documentazione è a posto (l’interessato deve portare 4 fototessera, un passaporto valido e prova della sua presenza in Italia prima del 26 agosto 2002), le due parti firmano un “contratto di soggiorno” e viene rilasciato un permesso di soggiorno valido per un anno. Questo è rinnovabile e vi permette di lavorare come colf (o bandante) anche per altri datori di lavoro. Non verranno prese impronte digitali fino al rinnovo di questo permesso di soggiorno.

L’UNICO COSTO SONO I 300 EURO DA VERSARE IN POSTA CON LA DOMANDA

Anche un’azienda può regolarizzare con la stessa procedura i propri dipendenti senza permesso di soggiorno valido. Ci sono però tre differenze: i moduli saranno disponibili in posta del 9 settembre e vanno presentati entro 30 giorni, il relativo versamento è di 800 Euro.
