Questionnaire on Migrants Domestic Workers

 

1)    Is there a register of foreign domestic workers in the Immigration Department and/or the Ministry of Labor of your country? If no, are there criteria to quantify the number of domestic workers on your country?

 

2)    Please provide available information on the number of nationals working abroad as domestic workers, if possible broken down by country of destination, sex and age

 

3)    Does the legislation of your country regulate domestic work? Please provide details, including with reference to labor and social legislation. Please also provide information relevant to the legislation applied to the children of migrant domestic workers who were born in your country, including for what concerns the right to education.

 

4)    Please provide available information of the situation of your nationals working abroad as domestic workers, including complaints of human rights violations recorded by the consulate and embassy personnel abroad

 

5)    Please provide information on measures taken at the national level to protect the rights of your nationals working in a foreign country as domestic workers, including in the context of recruitment and pre-departure. In this context, for example, are there criteria to certify recruitment agencies and to monitor them with a view to preventing illegal recruitment and trafficking of migrant domestic workers?

 

6)    Please provide information on assistance provided by the consular personnel of your country to migrant domestic workers abroad, as well assistance provided in the context of return and integration. Please also provide information about assistance provided to victims of trafficking and other abuses by your consular and embassy personnel abroad

 

7)    Does your national legislation protect the rights of migrant domestic workers in your country? Please provide available information on the main obstacles to the protection of their rights, if any, as well as measures undertaken to overcome them.

 

8)    Does the law of your country punish “slavery” and “forced labor”, as well as other violations to which migrants domestic workers are particularly vulnerable, such as the withdrawal of passports and identity documents by the employers.

 

9)    What are the legislative and administrative measures adopted by your country to prevent and punish trafficking of migrant domestic workers?

 

10) Please provide any other information that you deem relevant with regard to the protection of the rights of migrant domestic workers.
