In September
High-level Ministerial Round Table Discussion “Towards Strengthening the
External Dimension and Partnerships in Preventing and Combating Trafficking
in Women, The Future of the EU Anti-Trafficking Policy in the Lisbon Treaty
Era” took place.
The meeting in Vienna was meant as an expression of political will of States to combat trafficking in persons, especially women. The round table attende representatives
from neighboring countries, including Austria and Croatia. Vienna
declaration that was presented at the end of the meeting should symbolized the new beginning of cooperation among the invited countries. This cooperation - regional initiative is based on the principles adopted in the Treaty of Lisbon and Stockholm Programme and has the most
efficient implementation of existing instruments to combat the phenomenon
of trafficking especially in women. Czech Republic expressed its support for activities aiming to combat this crime, but in the context of this regional initiative was
concerned with the duplication of existing activities and the limited
number of countries invited to participate in the regional initiative.

JIT was set up concerning a criminal group which
organised illegal transportation of aliens across state borders of Estonia,
Latvia and Finland. The aliens of Afghan nationality were transported from
Republic of Latvia to Republic of Finland through Republic of Estonia. Based
on the information gathered by Estonian authorities the illegal
transportation of Afghan nationals was committed by a criminal group which
have been acting systematically.
The purpose of the JIT was to dismantle
abovementioned organised criminal group and to bring involved persons to
justice.

project “Developing Assisted Voluntary Return in Finland (DAVRiF)” was
launched on 1 January 2010. The overall goal of the project is to establish a
permanent framework for Assisted Voluntary Return in Finland that may
continue to provide migrants in Finland with voluntary return assistance also
after the end of the project.
Even
though it is a project aiming at collection of best practices and continuous
development, IOM will nevertheless in all project phases:

and consolidate assisted voluntary return practices and policies in Finland;
Support
cooperation and coordination between Finnish authorities and others working
with voluntary return;
Increase
the level of knowledge about assisted voluntary return amongst potential
returnees, project partners, and the public at large;
Assist
applicants
with
voluntary return arrangements and provide reintegration assistance to
eligible returnees.
Since March 2011, also victims of trafficking have
become eligible for assisted voluntary return under the project. IOM
coordinates and develops such returns in close cooperation with Joutseno
Reception Centre in Finland.

Training of police officers abroad:
at the request of the Ministry of Foreign
Affairs, as part of assistance towards equipment and training, the
Bangladeshi police received support in the form of training in order to help
combat trafficking in human beings. The seminar in question was held in the
Dhaka police training centre from 5 to 7 December 2010. The 18
participants belonged exclusively to the upper management of the police
force. The objective - to raise awareness among our Bangladeshi colleagues on
trafficking in human beings as a crime - was achieved.

BKA cooperates intensively in Germany on concrete
operational cases with the principal countries of origin of trafficking

Nigeria feature among these countries. Cooperation consists of close contacts
with, e.g., the Romanian liaison officer in Germany, missions to the said
countries and information exchange via Interpol and Europol.

Discussion of trafficking intelligence in Nigeria
|
From 22 to 25 November 2010 BKA and LKA Berlin staff travelled to Nigeria in order to discuss with
Nigeria's National Agency for the Prohibition of Traffic in Persons (NAPTIP)
concrete trafficking intelligence from investigations in Germany which had
revealed direct links with Nigeria. The direct contact with the Nigerian
police and the intelligence about the local situation and the potential of
the country's police force have contributed to a better understanding and,
hence, improved cooperation.

Lectures to international delegations
|
When international delegations visit the BKA, human lectures are regularly given on
human trafficking.
For example, the OSZE organised a study trip for Ukrainian
police officers, who visited the BKA on 18 November 2010. The participants
should be equipped to prevent trafficking in human beings and combat this
crime in the run-up to the 2012 European Football Championship, which will
take place in Ukraine and Poland.

Since 2006 the BMFSFJ (Federal Ministry for Family, Senior
Citizens, Women and Youth) acts on behalf of the Federal Government as member

and gives backing to its projects. It should be noted that on 10 June 2010,
in the context of the TF-THB Training on Human Trafficking for Diplomatic

Training Seminar

The aim of the Training Seminar was to improve
primary support to the individual victims, to increase knowledge about THB
among the staff responsible for consular matters and to provide participants
with tools to better assist victims through collaborating with the police,
social services, support organisations and others.
The training provided the participants with:
understanding of the nature of THB as well as knowledge of international and
national law; specific instructions regarding victims of trafficking to
increase comprehension of their vulnerable situation and to enhance the
support provided to them; knowledge on how to handle suspicious and actual
cases of THB within the embassies and with cooperating authorities in line
with international human rights standards; A clear understanding of the role
of diplomatic and consular staff in identifying, assisting and safely
repatriating victims of THB; above all, an opportunity for exchange of
experiences and best practices with other professionals and for establishing
relevant contact points.

This project was developed by ICMPD in cooperation
with Croatian authorities and funded by the Ministry of Foreign Affairs (MFA)
of the Netherlands. The project consisted of a series of
trainings in fighting human trafficking for Croatian police, border police,
staff of the public prosecutor and labour inspectors. The project proved
instrumental in creating greater awareness among Croatian law enforcement
authorities and labour inspectors of the issue of labour trafficking. At
the final conference of the project in September 2010 all countries from the
Western Balkan were represented and this provided a good opportunity for
discussing common problems. The possibility of a broader regional follow on
project is being considered.

This project built on the close relationship that
was forged with NAPTIP during the joint investigation code-named “Operation
Koolvis”. The project ran from July 2009 to June 2010 and was funded by the
Dutch MFA. The project consisted of a series of trainings given by a variety
of experts from Dutch law enforcement agencies (police, border police and
public prosecution services) to personnel of NAPTIP and other Nigerian
agencies including the Nigeria Immigration Service. The training covered
topics related to investigative capabilities as well as the intake and
referral of victims. A follow on project is currently being worked out. The
new project will span a three year period and consist of more advanced
training on some of the same topics as well as new topics such as witness
protection.

building capacity among local NGOs in Thailand, Cambodia, Philippines, Gambia
and the Dominican Republic to help them to wage awareness campaigns and lobby
local tourist organisations and hotel resorts to take a more active stance in
preventing and signalling child-sex tourism.

The project was implemented to continue
Polish-Moldavian activities undertaken in 2008.
The visit of the Moldovan delegation in Poland was organized
between September 21st and September 25th under the
above-mentioned project. During their stay the officers of the Moldovan
police visited the Warsaw Police Headquarters and the Vistula Border Guard
Unit, where they could get acquainted with the practices employed by Polish
services in the process of dismantling a criminal group, providing protection
to victims and securing evidence. Later the Moldovan delegation took part in
a Polish-Moldovan training seminar, organized by the Higher Police School in
Szczytno, during which the specific cases of international Police
co-operation in the area of combating the trafficking in human beings was
analysed in the form of a workshop. As a final result a publication on
combating the trafficking in human beings in Poland and in Moldova was
published.

implemented for all Member States of CBSS in the period 2008-2010.

Training seminar for consular personnel was
organised to present Polish system of combating and preventing trafficking in
human beings. Poland put special focus not only to invite consular personnel
based in Warsaw from EU and CBSS countries but especially from third
countries – countries of origin of victims identified in Poland
(European: Ukraine, Belarus, Bulgaria, Moldova, Romania as well as Asian and
chose African countries.
As a result of the project special manual for
consular personnel will be published in I half of 2011.

“Promoting Transnational Partnerships: Preventing and Responding

Trafficking in Human Beings in Brazil and EU member states”
To
make a comprehensive contribution to counter trafficking in human beings
efforts by reducing the incidence of trafficking in human beings from Brazil
to the EU Member States, particularly Portugal and Italy, in the medium to
long term

conduct research identifying the vulnerable and at-risk groups as well as the
relevant transnational trafficking routes;

design an awareness raising campaign based on the information collected in
the
research component, a pamphlet and a launch and distribution strategy will be

developed in coordination with all project partners and associates the

conduct research on the existing procedures regarding the transnational
referral of victims and training gaps and needs analysis of the Brazilian
Federal Police;

collected during both researches; i.e. the research component

Additional information related with internal actions (from October 2009 until March
2011) with impact in external dimension:
The
project "Development of a transnational referral mechanism for victims of
trafficking between countries of origin and destination (TRM-EU)" –
Programme “Criminal Justice”, tnaht CIG was the portuguese element involved
finalized in February 2010.
In the first trimester of 2010, the Observatory on
Trafficking in Human Beings and Commission for Citizenship and Gender Equality
developed a training for 55 labour inspectors, which aim was to improve the
knowledge on the THB phenomena, especially concerning the national referral and
monitoring system.
CIG promoted the elaboration of the final report of
implementation of the First National Plan Against Trafficking in Human Beings,
coordinated by CES (Centro de Estudos Sociais).
Creation and implementation of The Second National
Plan Against Trafficking in Human Beings (2011-2013) is structured according to
a model that defines four strategic intervention areas, outlining 45 measures
for its functioning All of these measures are linked to the entities
responsible for their execution, as well as to process and result indicators.

judges, prosecutors, journalists, lawyers and public and private institutions
who play an active role in the protection of victims, the conference’s main

exploitation of minors, prevention and monitoring of risk groups, among others,
regarded as factors for the establishment of effective and concrete measures

During 2009, help and protection for victims under an
international plan, the Spanish Master Plan 2009-2012 for Cooperation, included
specific lines of strategy and priority action to tackle the problem
efficiently on the ground (through bilateral cooperation and the contribution
to MDGs in the migration and development sector), such as establishing or
reinforcing regulatory frameworks for social protection of migrants on a
bilateral or regional scale, combating the trafficking and exploitation of
migrants, in particular trafficking women and girls for sexual exploitation. It
also includes prevention, protection and help for victims of trafficking and
sexual exploitation in conflict or post-conflict situations within the
framework of application of Resolution 1325 of the UN Security Council.
In addition, the following projects have either been
finished are still in process:
FINANCIAL SUPPORT FROM AECID FOR THE PROJECT
"STRENGTHENING NATIONAL AND REGIONAL POWERS TO PREVENT AND COMBAT HUMAN
TRAFFICKING IN CENTRAL AMERICA" BY UNODC (UNITED NATIONS OFFICE ON DRUGS
AND CRIME, 2007-2010): The aim of the project is to identify the legal,
institutional, technical, operational and financial capacities of central
American countries to prevent, investigate and judge the crime of trafficking
and to protect victims and witnesses.
PROGRAMME FOR REGIONAL COOPERATION WITH CENTRAL
AMERICA – GENDER AGENDA: SUPPORT TO REINFORCE COMMCA (COUNCIL OF
MINISTERS FOR WOMEN IN CENTRAL AMERICA), WORKING THROUGH SISCA (SOCIAL
INTEGRATION SYSTEM IN CENTRAL AMERICA) RUN BY THE IOM (INTERNATIONAL ORGANISATION
FOR MIGRATION). Seven national and one regional study have been made on
"The experience of women victims of trafficking and action taken by
institutions", in support of the Action Plan against Trading and
Trafficking Women by the Council of Ministers for Women by making one regional
study and seven national studies on Central American countries and the
Dominican Republic. Studies on the pertinent legal processes were also made.
Priority areas for intervention were identified in
order to enable AECID to draw up a regional strategy on gender, including
matters of trafficking. Thus, at the
beginning of 2009, the "CREATION OF A REGIONAL HELP CENTRE FOR VICTIMS
OF HUMAN TRAFFICKING CRIMES IN TAPACHULA AND TRAINING FOR MEXICO AND CENTRAL
AMERICA" project was
started, with a total budget of 400,000€, of which 200.000€ was provided by
AECID, and the rest by the secretary of Public Security in Mexico.
Extension of the Project to create a HELP CENTRE FOR VICTIMS OF HUMAN TRAFFICKING
CRIMES IN MEXICO, which is
at the planning stage. Budget: 280,000 €.
AGREEMENT TO REINFORCE THE POWERS OF GOVERNMENT AND
CIVIL COURTS FOR THE INTEGRAL PROTECTION OF CHILDREN AND ADOLESCENTS, IN
PARTICULAR FOR TRADING AND TRAFFICKING CHILDREN AND ADOLESCENTS IN ECUADOR, EL
SALVADOR, GUATEMALA, HONDURAS AND NICARAGUA, 2007-2010. The purpose of the
Agreement is to tackle prevention and to protect vulnerable girls, boys and
adolescents and / or victims of trafficking crimes in Central America, and the
subject of protecting childhood, preventing violence, and the rights of
adolescent workers in the Andes area.
Furthermore, a Framework Agreement has been signed for
collaboration between the Ministry of Equality and AECID to mainstream the
current focus on gender and to combat any form of discrimination. Similarly, a
specific Agreement has been signed to carry out joint training by preparing a
course o on human trafficking for sexual exploitation. As part of the specific
Agreement, a course was organised and prepared in 2009 on "The trade in
women and girls for sexual exploitation: a global reality", which will be
held in 2010. Likewise, three courses have been given on trafficking within
AECID's Ibero-American programme of special technical training, in centres
where Spain cooperates with Latin America, in Montevideo (organised by CICO,
Ministry of the Interior), in Guatemala (aimed
at prosecutors), and in Bolivia.
Outside Latin America, AECID has also carried out a
multi-disciplinary project to combat trafficking for sexual exploitation, and
to help victims in the sub-region of the Mekong to integrate. This is part of
tackling the eradication of trafficking and sexual exploitation in the area and
making it easier for victims to be rehabilitated and reinserted into society by
reinforcing government and non-governmental policies and strategies on
trafficking at a national and regional level.

world congresses on commercial sexual exploitation of children which includes
70 reports on the work against commercial sexual exploitation of children in
70 countries. An international conference was held in October in Bangkok for
follow up of WCIII.

The programme focuses on prevention of abuse,
violence and exploitation of children and on establishment of national
mechanisms for child protection. UNICEF’s upstream work in combating child
trafficking is evidence of its leveraging and influencing role in
establishing strong systems of protection; in 2009, a total of 41 Country
Offices engaged in policy advocacy and the development of legal frameworks to
combat adult and child trafficking. At the global level, UNICEF worked with
13 other UN and international organizations to co-author the International Framework
for Action to Implement the Trafficking in Persons Protocol – a
technical tool that provides a step by step implementation guide for Member
States to fulfil their commitment to the Trafficking in Persons Protocol,
including operational indicators to monitor progress

UNIAP ’s multi-partner and multi-sectoral approach has
proved to be successful in raising awareness about the problem in the region, mobilising
governments, multilateral partners and civil society into concrete action and
cooperation and building capacity, facilitating legal change and
prosecution of offenders, and protection and
rehabilitation of victims. Several countries now have specific national laws on
human trafficking in place: Cambodia (2008), Myanmar (2005), and Thailand
(2008) , and there is growing recognition on the need for appropriate laws to
be complemented by strong legal processes governing issues such as victim/witness
support and protection, criminal procedures, as well as clarity and standards
of evidence. With regard to law enforcement, specialist anti-trafficking police
units have been established in many of the GMS Countries (Cambodia, Lao PDR,
Myanmar, and Thailand), and the heads of these units meet intermittently to
share case information and intelligence.

EU Directive Human Trafficking
The UK Government intends to
apply to opt in to the EU Directive on Human Trafficking. On 22 March the
Minister for Immigration wrote to the Parliamentary Scrutiny Committees in
the House of Commons and the House of Lords, seeking their views. Both Houses
have now cleared the Directive from scrutiny, and we will shortly be applying
to the European Commission to opt in.
If our application is successful, we will
work closely with the Commission on implementation. There is some
flexibility in how we achieve the aims of the Directive and we will look at
the best ways of doing this. Our current assessment is that we would be
required to:
· widen one existing offence of trafficking
for forced labour;
· amend existing trafficking offences to
confer extra-territorial jurisdiction over UK nationals who commit
trafficking offences anywhere in the world;
· make mandatory some measures which are
currently good practice (for example, appointing special representatives to
support child witnesses during police investigations and criminal trials);
· set out the rights of victims to
assistance and support.

Operation Golf
Operation Golf
was set up as a direct result of Metropolitan Police Service (MET)
investigations finding 200 Romanian Roma children involved in crime across
London in 2007. These were identified as part of a larger group of 1107
victims suspected of being trafficked across Europe by one organised criminal
network (OCN).
Following
Romania’s accession to the EU the Romanian National Police investigated the
trafficking of Roma children into forced criminality across Europe.
From 2006/7 they identified 1107 children had been trafficked from Tandarei
in southeast Romania into Western Europe. The OCN operated mainly in
the UK, France, Spain and Italy. Children were trafficked mainly to beg
and steal in various European countries.
The need for
joint police work between the UK and Romania led to the Joint Investigation
Team (JIT) being set up on September 1 2008. This gave a co-ordinated
and focused approach between the police forces of both countries to disrupt
the criminal activities of the Romanian gang, arrest the offenders and rescue
the victims.
The MET assisted
the Romanian National Police in arresting and prosecuting 26 suspects of the
criminal gang by providing evidence of offences in 41 police force areas and
the circumstances around the forced criminality of identified children.
181 trafficked children were identified as a result.
Up to December
2010 police investigations in the UK led to the arrest of 146 suspects
charged for a variety of crimes including human trafficking into the UK;
trafficking within the UK; money laundering; benefit fraud, child neglect;
perverting the course of justice; theft and handling stolen goods. Over
80 people to date have been convicted in the UK and one case if undetected
could have seen a loss of £12.6 million through fraud.
As
part of Operation Golf, the launch of Operation Norman on 12 October 2010 on
16 premises safeguarded 41 children and arrested 8 adults. The
operation was jointly planned with Redbridge Council and the local health
trust. After being assessed for risk of harm and welfare needs, 40
children were returned to their families and one girl was placed temporarily
with foster carers. Local authority children’s services support will
assist any of the children should an assessment require this.

RALON
The UK Border Agency’s Risk and
Liaison Overseas Network (RALON) works in more than 50 locations worldwide to
identify and mitigate threats to the UK border.
As part of this work, RALON
officers work with airlines and local border control authorities to ensure
passengers hold the right travel documents before they travel to the UK. Last
year the network prevented over 68,000 people with incorrect, counterfeit or
fraudulently obtained passports or visas from travelling to the UK.
RALON officers have provided
training to carriers on routes that are commonly used by traffickers to
enable them to identify potential traffickers and their victims.

CEOP
The Child Exploitation and
Online Protection Agency (CEOP) is continuing to form and enhance
partnerships in the main source and transit countries to obtain more
information on recruitment, routes trafficked, modus operandis and joint investigation practices
between law enforcement agencies.
CEOP contributes to the Home
Office Threat Assessment and UKBA’s Strategic Threat Assessment to highlight
intelligence requirements and to share data. By working together in
partnership and taking advantage of SOCA’s existing links and CEOP’s
International Child Protection Network (ICPN) in source and transit
countries, intelligence gaps can be better addressed.
By combining CEOP and local
expertise in child protection, the ICPN works with existing infrastructure in
source countries to identify and protect potential child victims of
trafficking.

Human Trafficking Strategy
The Government will publish a
new strategy to tackle Human Trafficking in the Summer. This was announced by
the Minister for Immigration on14th October 2010 during debate on
Anti-Slavery day. The Strategy will set out what steps we will take across
four key areas:

Disrupting trafficking networks
before they reach the UK
2.
Smarter multi-agency
working at the border
3.
More co-ordination of
our law enforcement efforts in the UK.
4.
Improved victim care
arrangements.
Through the human trafficking
strategy we want to maintain the focus on supporting victims, while
signalling a greater emphasis on using a range of enforcement approaches to
prevent people becoming victims and trafficked into the UK.
The strategy’s overall aim is to
minimise trafficking into the UK, by making it a significantly more difficult
environment for traffickers to operate in.
As the Minister for Immigration
set out in his speech on Anti-Slavery Day, the Government wants to see more
activity to tackle the problem in source countries, smarter multi-agency
working at the border, more co-ordination of our law enforcement efforts in
the UK and improved victim care.
In particular, we want to raise
the risks traffickers face and decrease their profits so we drive them out of
this horrendous crime.

Part A: State of play ongoing agreements (in
alphabetical order)
I.
Operational
Agreements
1.
Albania
The process for the conclusion of the
agreement was initiated in December 2007 when the data protection questionnaire
was sent to Albania. The completed questionnaire was received from Albania in
January 2008. The reply from Albania to additional questions from Europol was
received in October 2008. The finalisation of the paper-based scrutiny of the
data protection legislation was on hold pending additional questions identified
by Europol, replies to which were received in June 2010. After a first
scrutiny, Europol has sent a list of additional questions in preparation for a
data protection study visit to Albania. This visit is scheduled for the second
week of June 2011.
2.
Bosnia and
Herzegovina
The process for the conclusion of the
agreement was initiated in the first quarter of 2009 when the data protection
questionnaire was sent to Bosnia and Herzegovina. The answers were received in
April 2009. Following an initial scrutiny of the data protection legislation,
Europol is working on a list of additional questions which will be sent to
Bosnia and Herzegovina shortly after which a data protection study visit can be
considered (3nd Quarter of 2011).
3.
Colombia
The operational agreement was signed by the
Director on 20 September 2010 in Colombia. Europol is awaiting the finalisation
of the ratification process by Colombia, which is anticipated to occur during
2011, after which the agreement will enter into force.
4.
Former Yugoslav
Republic of Macedonia
The negotiations for an
operational cooperation agreement took place in The Hague on 15-17 December
2009. During the MB meeting on 3-4 February 2010 it was decided to change the
closing formula, which referred to the language of the agreement. Following
bilateral talks with the Ambassador of the former Yugoslav Republic of Macedonia
in The Hague on 17 March 2010, an alternative solution was found which was
accepted by the MB of 23-24 March 2010. The MB agreed to recommend the Council
to authorise the conclusion of the agreement. Council authorised signature in
July 2010. The signing ceremony, scheduled for 13 September 2010 was cancelled
at short notice by the former Yugoslav Republic of Macedonia due to advice from
the Council Legal Service (CLS) confirming that the way of exchanging
signatures proposed by the former Yugoslav Republic of Macedonia was not in
line with EU policy. In close cooperation with different units of the COM, a
meeting between Europol representatives (G3) and the deputy Head of Mission of
the former Yugoslav Republic of Macedonia to the EU took place on 20 April with
the aim of finding a solution acceptable to all parties.
5.
Israel
At the MB in October 2010, agreement was
reached on a text for revised versions of Articles 7 and 8 of the draft
agreement. The proposal has been sent to the Israeli Ministry of Justice.
Europol organised a meeting in March 2010 with representatives of the Embassy
of Israel in The Hague in which the Israeli position towards the Europol
proposals for Article 7, 8 and 15 was clarified. Whilst the proposal for
Article 7 and 15 are in principle acceptable for the Israeli authorities, a
compromise solution for Article 8, safeguarding the principles agreed on by the
MB, is currently under discussion. The competent services of the European
Commission will be closely involved.
6.
Liechtenstein
The process for the conclusion of an
operational agreement was initiated in the third quarter of 2008 when the data
protection questionnaire was sent to Liechtenstein. Europol has received a
reply and copies of the relevant laws in May 2009. A first scrutiny of the data
protection legislation took place and additional questions were sent to
Liechtenstein on 15 March 2010. Additional answers were received in June 2010.
Europol has sent a list of additional questions in preparation for a data
protection study visit to Liechtenstein. This visit is scheduled for the last
week of May 2011.
7.
Moldova
The process for the conclusion of an
agreement was initiated in the first quarter of 2009 when the data protection
questionnaire was sent to Moldova. A first reply was sent to Europol in May
2009. An update of the questionnaire and additional set of documentation was
sent to Europol in April 2010. Europol completed its first scrutiny of the
material received and sent additional questions to Moldova in January 2011.
Awaiting the reply from Moldova, Europol will further proceed with the
assessment of the data protection legislation in Moldova. Should Europol come
to the conclusion that it is suitable to assess Moldova’s data protection
framework in practice, the data protection visit could be scheduled for the
second half of 2011.
8.
Monaco
The Council authorised the Director to sign
the operational agreement. The agreement will be signed in Monaco on 6 May 2011
and will enter into force on the day Monaco notifies Europol that it has
ratified the agreement, which is expected to follow shortly after the signing
ceremony.
9.
OLAF
Europol and OLAF initiated the process for
the conclusion of a working arrangement allowing for the exchange of personal
data in line with Article 22 of the Europol Decision. A first negotiation
meeting was held at OLAF on 09 April 2010 during which a draft Chapter on
information exchange was discussed. Negotiations were then discontinued
awaiting the appointment of the new OLAF Director. However, in accordance with
Article 22(3) of the Europol Decision, Europol is at present - prior to the
entry into force of the arrangement - able to directly transmit personal data
to OLAF. OLAF has been invited for a further negotiation meeting, on the basis
of the new approved model agreement. Different opinions exist in relation to
the use of the model agreement for the establishment of the working
arrangement. Europol is awaiting the reply from OLAF

Russian
Federation
The MB authorised the Director to enter into negotiations with the
Russian Federation at its meeting in May 2010. As part of this process, Europol
held a Conference on open data protection questions with participants from the
Russian Federation, the JSB, the COM, the General Secretariat of the Council
and Member States on 19-20 October 2010, followed by a first round of bilateral
negotiations on 21-22 October 2010. The outcome of this conference was made
available, inter alia, to the JSB. A second round of negotiations was held on
4-6 April 2011 during which a considerable part of the text was provisionally
agreed upon. In preparation for a third round of negotiations provisionally
planned for June 2011, further exchanges of text proposals are ongoing.
11.
Serbia
Initiating steps towards the negotiation of
an operational agreement have been taken with Serbia, with an initial reply to
the data protection questionnaire received in September 2009. Based on a number
of developments in the data protection framework by Serbia, the data-protection
questionnaire was re-submitted to Serbia in August 2010, and replies received
in September 2010. The first scrutiny of the data protection legislation in
Serbia was completed in January 2011 and additional set of questions was sent
on 07 March 2011. Europol is awaiting the reply from Serbia.
12.
Turkey
Europol has sent for
information purposes a data protection questionnaire in February 2006 and has
sent a letter with information about the steps to be taken for concluding an
operational agreement in June 2008. No answer has been received to date. The
Turkish Ambassador to the Netherlands, in a meeting with the Director of
Europol on 19 April 2010, reported that a new data protection legislation is
currently before the national parliament and is likely to be adopted later this
year, which will allow the next steps towards an agreement with Europol to be
taken. The Ambassador confirmed the interest of Turkey in concluding an
operational agreement with Europol. No further update is currently available.
13.
Ukraine
The strategic agreement was signed during
the EU-Ukraine summit in Kiev on 4 December 2009 and ratified by the parliament
in November 2010. The formal notification thereof was provided to Europol
during the visit of the Ukrainian Minister of the Interior on 16 November 2010
triggering the entry into force of the strategic agreement.
Ukraine expressed its interest to move
forward towards an operational agreement and insists on initiating the process
for that. A meeting between with the Counsellor for Political Affairs and
Europol took place in the Embassy of Ukraine in the Netherlands on 12 April
2011, during which Europol explained the different steps and requirements for
the drafting of a data protection report which is the major step in the
establishment of an operational cooperation agreement. Considering that the
national data protection supervisory body is not operative yet, Europol suggested postponing the initiation of the
process and to send the questionnaire in the second half of 2011. Ukraine is currently
reflecting upon this proposal.
II. Strategic Agreements
1.
ECDC (European
Centre for Disease Control)
The negotiations on a strategic agreement
between the European Centre for Disease Prevention and Control and the Europol
took place in Stockholm on 22 - 23 February 2011 and were based upon the new
model agreement for strategic cooperation which was adjusted to the specific
nature of the agency ECDC (EU agency) and the specific nature of the cooperation between
Europol and ECDC (threats to public health emanating from terrorist or
criminal activity). The draft
agreement was submitted to the ECDC Management Board in March 2011. However,
the draft agreement was not approved due to a scrutiny reservation from the COM
representative in the ECDC MB. The draft agreement which was also tabled for
the Europol MB of March was therefore removed from the agenda. Europol is in
contact with the COM in order to find a suitable solution for the problems
identified by the COM after which the draft agreement could be resubmitted for
adoption to the respective MBs.
2.
China
First contacts have been made by the
Chinese Mission to the EU. The Defence Advisor visited the Director on 4
November 2009. The process on reaching an agreement was explained by Europol
but it was made clear that for the time being China does not intend to ask for
a cooperation agreement with Europol.
3.
Morocco
First contacts were initiated by means of a
meeting with representatives from the Moroccan Embassy in November 2008. An
information letter was sent in April 2009 and an official invitation to
initiate negotiations was sent in July 2009.
At its meeting on 8 July 2009,
the MB decided that for the time being, Europol should negotiate a strategic
agreement with Morocco. The Minister of Foreign Affairs of Morocco responded by
letter of 06 October 2009 positively to Europol’s request to initiate the
process of negotiating a strategic cooperation agreement between Morocco and
Europol. A letter was sent on 28 October 2009 explaining Morocco the different
steps to be followed for the establishment of the strategic cooperation
agreement. No reply has yet been received from Morocco.
III. Countries recently added to the
Council list
1.
India
On 26 February 2009, the Council decided to
add India on the “Council list” of third parties with which Europol may
negotiate a cooperation agreement. At its meeting on 8 July 2009, the MB
decided that for the time being, Europol should negotiate a strategic agreement
with India. On 6 October 2009, the Director sent a letter to the Indian mission
to the EU together with a model strategic agreement for Indian’s information.
The Central Information Bureau (CBI) in New Delhi has made a first series of
comments on the model agreement. India expressed its willingness to sign the cooperation
agreement during the EU-India summit in October 2010. However, despite two
scheduled dates for negotiations in June and July 2010, with India cancelling
both at the last moment, no further reply has been received since then, despite
numerous attempts from Europol’s side to obtain such information. In November
2010, Europol was (again) informed by its Indian contact point that
instructions from New Delhi are still pending. It is envisaged to propose to
India to hold a seminar on the possibilities and benefits which would result
from the cooperation between India and Europol.
